PRIVACY POLICY

In order to place an order or to access certain features or services on the LUMA Website, you may be required to first create an account or become a LUMA Website member and complete one or several forms. During registration (and possibly thereafter) you may be asked to give your name, a contact telephone number, a PIN or password, your postal address, delivery address, e-mail address, and other contact or pertinent information. LUMA may also ask for other information required to provide a particular service. Information may also be collected by your presence on the LUMA Website, even if you have not registered or subscribed.

Generally, this information falls into one of four categories: (1) “Personal Information,” such as your name and e-mail address, which can be used to personally identify or contact you (or to confirm your identity in the case of user IDs and passwords), (2) “Billing Information,” such as your credit card information, which is a subset of Personal Information and which we may use to bill you for a service you have knowingly purchased, (3) “Usage Information” such as your IP address, click patterns on the LUMA Website and other information indicative of your purchase patterns and use of the LUMA Website, and (4) “Anonymous Information” which is extracted from Personal Information and Usage Information and then aggregated across users to determine the demographics, habits, preferences, or statistical characteristics of the LUMA Website users, but which cannot be used to identify you or your specific usage history.

We may collect the following categories of information on our website and use them for the purposes explained below.

• Website activity: Data about your browsing activity on our website
• Device and browser information: Technical information about the device or browser you use to access our website. For example, your device's IP address, and (in the case of mobile devices) your device type and mobile device's unique identifier such as the Apple IDFA or Android Advertising ID.
• Contact Information: If you choose to provide your name, email address or phone number
• Account Information: If you open a account, we will collect your username and a password and other information to necessary to open and access your account
• Customer Service Information: Information you may provide to customer service including survey responses
• Third party information: We may collect additional information about you from third party sources where we have the rights to do so.

We use this data to:

• provide LUMA services and customer support
• prevent potential fraud and enforce our Terms of Service
• customize, measure, and improve our website and services
• deliver targeted marketing to you
• contact you by email or phone about your account or our services including to market our services to you
• to regulate access to the LUMA Website and its features and services, as well as to your account
• to personalize and enhance your experience when visiting the LUMA LUMA Website
• to promote to you LUMA services (including contacting you by e-mail) provided that you may opt-out of receiving promotions from us through various mechanisms we provide (for example, an unsubscribe link at the bottom of newsletters and promotional emails)
• for other internal or administrative purposes consistent with our mission of providing our users and members with the highest quality experience in a secure manner, including contacting you about critical updates to the LUMA Website or the services you purchase or use. You can choose not to provide us with certain information, but that may result in you being unable to participate in certain services that we offer.
• We will use your Billing and Usage Information, as applicable, to bill you for any LUMA services which you knowingly purchase, and to provide you with technical and billing support.
• We will use Anonymous Information to optimize our marketing and product development efforts (such as search engine optimization) and other relevant commercial purposes which do not identify you individually.
• LUMA may use third party providers and subcontractors to process your payments, for web site hosting and to support features and services offered on the LUMA Website. Service through these providers may necessarily include providing them with some or all of your Personal Information, Billing Information (for credit card processing, collections, and related matters), and your Usage Information (for subcontracted services and features), but we will use diligent efforts to restrict use of this Information by these third parties to the specific purpose for which the third party has been engaged.
• In addition, LUMA specifically reserves the right, to the maximum extent permitted by law, to use or disclose any Information (a) for the purposes of enforcing our user agreements, use policies and the like or (b) when requested by law enforcement agencies (whether or not under subpoena).
• LUMA has used reasonable efforts to put in place appropriate technical and organizational security measures to protect against the loss, misuse and alteration of user data under our control. For example, we will use appropriate encryption for payment card transactions if and when we bill you for a product or service, and we impose strict rules on LUMA employees who have access either to the databases that store member or user information or to the servers that host our services. While we cannot guarantee that loss, misuse or alteration of data will not occur, we make diligent efforts to prevent such unfortunate occurrences. We will not permanently store your credit card or other payment information (if applicable) unless you knowingly consent to such storage and unless we have implemented appropriate PCI (payment card industry) compliant measures to do so.
• Billing Information may also be stored by our payment card processors and be subject only to our limited control.
• Additionally, we strongly recommend that you keep all of your user information, such as account IDs, passwords, and other sensitive information secret and not disclose such information to anyone else. We cannot be responsible for any use of this information should you disclose it to anyone else, or for the use or distribution of any of your information or data stored with the LUMA Website if it is obtained via use of your account ID or password. Please note that LUMA will never e-mail you to “phish” for (attempt to convince you to disclose) your username or password or any billing information via e-mail.
• Personal Information Collected by LUMA

This Policy does not cover the privacy and security practices of the social media sites on which LUMA has social media pages. Please review the privacy policies and terms of use on the social media sites if you have any questions about their privacy or security practices. The social media sites where LUMA has it social media pages may provide aggregate information and analysis to LUMA about visitors’ use of our social media pages. This allows us to better understand and analyze our user growth, general demographic information about the users of our social media pages and interaction with content on our social media pages. Overall, this information may be used to help us understand the types of visitors and users of our social media pages and use of the content.

• Other Events - Please note that all information and material collected or provided, in any manner and of whatever nature, may be transferred or assigned by LUMA in conjunction with a merger or the sale of all or a portion of the LUMA business (or similar event).
• Children - The LUMA Website and the services we offer are not intended for use by persons under the age of 18. Children and minors may not use the LUMA Website.

We may disclose information about you:

• With our service providers: Companies we contract with who help with parts of our business operations. We require that our service providers only use your information in connection with the services they perform for us.
• With your service providers: Companies under contract with, or acting on your behalf, who handle data (such as a customer lists) on your behalf.
• With our subsidiaries and related companies
• In connection with legal proceedings: When we are under a legal obligation to do so, for example to comply with a binding order of a court, or where disclosure is necessary to exercise, establish or defend the legal rights of LUMA, our Advertisers or any other third party.
• In connection with a sale of our business: If a third party acquires some or all of our business or assets, we may disclose your information in connection with the sale.
• We also share technical data that we collect about your browsing habits and your device (such as data relating to our cookies, tracking pixels and similar technologies) with other advertising companies in the digital advertising ecosystem. This enables them and us to better target ads to you.

Finally, we may disclose aggregated, anonymized information to third parties. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.

The LUMA website uses cookies, tracking pixels and related technologies. Cookies are small data files that are served by our platform and stored on your device. Our site uses cookies dropped by us or third parties for a variety of purposes including to operate and personalize the website. Also, cookies may also be used to track how you use the site to target ads to you on other websites.

We recognize how important your online privacy is to you, so we offer the following options for controlling the targeted ads you receive and how we use your data:

• You can opt-out of receiving targeted ads served by us: You can opt out of receiving targeted ads served by us or on our behalf by clicking on the blue icon in the corner of the ads we serve or by clicking here. Please note that, if you delete your cookies or upgrade your browser after having opted out, you will need to opt out again. Further, if you use multiple browsers or devices you will need to execute this opt out on each browser or device. If you opt-out we may collect some data about your online activity for operational purposes (such as fraud prevention) but it won't be used by us for the purpose of targeting ads to you.
• You can opt-out of receiving targeted ads served by us or other advertising companies: LUMA adheres to the NAI Codes of Conduct. You may use the NAI opt out tool here, which will allow you to opt out of seeing targeted ads from us and from other NAI approved member companies.
• We also comply with the Self-Regulatory Principles for Online Behavioral Advertising as managed by the Digital Advertising Alliance (DAA). You may opt out of receiving targeted ads from other companies that perform ad targeting services, including some that we may work with as Advertising Partners via the DAA website here.
• Please note that when using the ad industry opt-out tools described above:
  • If you opt-out we may still collect some data about your online activity for operational purposes (such as fraud prevention) but it won't be used by us for the purpose of targeting ads to you.
  • If you use multiple browsers or devices you may need to execute this opt out on each browser or device.
  • Other ad companies’ opt-outs may function differently than our opt-out.
• You can request that we stop email marketing to you. You can use the unsubscribe link in our marketing emails or contact aprild@lumasearch.com.

Some internet browsers allow users to send a "Do Not Track" signal to websites they visit. We do not respond to this signal.

Marketing Email Communications

• At various points on the LUMA Website, you have the option to join our email list and receive information about our services and other related information. Also, if you provide us with your email address when you register online or update your account, you may automatically be added to our email list and receive marketing or promotional information from us. Without your authorization, LUMA will not share your email address third parties or with anyone outside of LUMA.
• If you do not wish to receive LUMA marketing emails, you may opt out, or unsubscribe, by clicking on the unsubscribe link found at the bottom of all LUMA marketing emails, or email April Davis at aprild@lumasearch.com “Email Unsubscribe” in the subject line and your name and email address within the email message or click the "Unsubscribe" button. Please note that it may take several days for your unsubscribe e-mail to be processed, and using the unsubscribe link in a newsletter generally results in prompt processing.

Identifiable information about you is held no longer than necessary for our business purposes or to meet legal requirements.

LUMA reserves the right to reasonably modify this Policy at any time by publication on the LUMA Website, by notice through email, or by other reasonable notification means. All such modifications will be binding on all registrants and users. Please check back periodically to review the current Policy.

The terms contained in this Policy are subordinate to any contrary terms contained in any express membership agreement, affiliate waiver or to any express written agreement containing the signatures of authorized representatives of both parties.

LUMA’s liability from or arising out of this Policy or any breach thereof shall be, regardless of theory of liability or cause of action, limited to direct damages, shall not exceed US$100.00 under any circumstance.
